First Lesbian Divorce Granted in Texas
I am glad to see someone in Texas has read more than just the 2nd Amendment to the United States Constitution.
Although a fan of the 2nd my favorite today is Article IV Section 1…the Full Faith and Credit Clause. To paraphrase, States within the United States have to respect the “public acts, records, and judicial proceedings” of other states. If legally married couples in Massachusetts can get a divorce in Texas then the fact that they are a same-sex couple makes no difference.
A San Antonio woman in the middle of the gay marriage debate has been granted the state’s first gay divorce.
An Austin judge has denied Texas Attorney General Greg Abbott’s request to intervene in the same-sex divorce.
The couple were married in Massachusetts in 2004. They filed for divorce in Travis County.
Abbott argued unsuccessfully that, since the couple’s marriage was not valid in Texas, neither should be their divorce.
